Terms of Service

Limited Economic Liability

In no event will our liability exceed the VECP credit related to the subject VECP.

Limited Liability Agreement

We work hard to ensure our advice is true, correct, and useful. The use of our systems accesses the combined knowledge of our professionals. However, we cannot be responsible for the acts of others, or misunderstanding of others. Further, our advice cannot cover every issue, known or not. The user agrees to hold us harmless for any issues they may incur.

Expert Testimony, Including the VECP Program Behaviors and Relationships

The user, and all groups related to them using our systems, agree that giving any expert advice beyond that given within our systems is not a condition of use and must be compensated at our normal rates. This includes, but is not limited to: dispositions, generation of reports, review of operational data, testimony in court and preparation for it, travel, requests reducing our consulting availability,

Service and Support Requests

In no event will our service and support liability exceed 15 minutes per VECP credit. Any request beyond this will be billed at our normal consulting rates. Court, disposition, and at court site activities are billed at 2x the normal rate. We attempt to assist our clients. In no event does our assisting clients beyond this level indicate a waiver of this requirement and agreement to it.

Fraud, Malfeasance, Misrepresentation, and Misuse

The user agrees to not use our systems or services for the purposes of fraud, malfeasance or misrepresentation. Misuse of our systems include attempting to view others activities, improper attempts to cross from contractor to contracting officer/manager, or use of the systems and knowledge base to attempt fraud, misrepresentation, or misuses of the VECP process and its purposes. Determination of such activities is at the sole discretion of VECP Consulting and is not subject to discussion. In the event of violation of this clause, all funds are forfeit to VECP Consulting and the client may be deemed liable for damages. Damages will include attorney fees, collection agency fees, a penalty of $300, and interest of 1.5% per month, compounded monthly.

Nonpayment or Payment Rejected After the fact

Nonpayment of a payment rejected after the fact (charge back, stop check, fraudulent check or credit card) is considered misrepresentation and is subject to the same penalties as the clause above.

If you do not agree

If you have not used your credits, we will refund them. If you have, they are forfeit as you have used the system and gained knowledge (a benefit) from it. Use of the system is agreement of the terms of service.
